Public Works Contracts — What You Need to Know

Public works contracts cover construction, renovation, repair, and improvement projects funded by public agencies like Skagit PUD. These contracts are awarded to the lowest responsive responsible bidder through a competitive bidding process.

Washington State law (RCW 39.04) requires that all public works contracts be advertised publicly and awarded to the lowest responsive, responsible bidder. Smaller projects may be awarded through a Small Works Roster process, which allows qualified local contractors to be considered without a full competitive bid.

To be eligible for award, contractors must meet Washington State's criteria for responsible bidders, including proper licensing, bonding, and a satisfactory performance record.

The Small Works Roster is a list of qualified contractors available for smaller public works projects. It allows Skagit PUD to solicit bids from pre-qualified contractors without going through the sealed bid process required for larger projects.

Any licensed and responsible contractor can request to be added to the roster at any time by submitting a written application and keeping current records on file, including licenses, certifications, bonding, and insurance. Contractors must also be able to receive notifications by email.

When applying, contractors are asked to indicate whether their business qualifies as women-owned, minority-owned, veteran-owned, or a small business under Washington State definitions.

Skagit PUD publishes a roster notice at least once a year to solicit new contractors and ensure the list stays current.
